OVERVIEW:

The district was created as a Water Control District by court order in 1971. The district operates primarily under the Florida Statutes in Chapter 298 and though several special acts of the Florida Legislature which have adjusted the boundaries and authorized the District to maintain the roads with Flagler Estates.� The District encompasses over 6181 accessible acres.

PURPOSE:

The District's purpose under Florida Statutes is to preserve, restore and protect the availability of surface water resources for public health, welfare, and convenience. In addition to water control duties; the District is also empowered to maintain streets, roadways and roads necessary and convenient to provide access to and efficient development of areas made suitable and available for cultivation and settlement, urban and suburban, and other beneficial use and development as a result of the drainage, irrigation and reclamation operations of the District.

To accomplish these tasks, the District imposes and annual non-ad valorem maintenance assessment on a per acre basis to cover the operations and maintenance of the District. This assessment is collected through the County and is separately reflected on your annual property tax bill.

The current assessment is $189.00 per acre as of August 2005.

STRUCTURE AND MEETINGS:

The District is an independent Special District, governed by the elected three-person Board of Supervisors (All of whom are landowners in the District). The Board serves as the Agency Head and exercises all regulatory and executive powers.

The Board of Supervisors has Workshop and regular meetings on the first and third Thursday of every month at 7:00 pm. All meetings are open to the public and are held at the District Office located at 9850 LIght Ave. The DIstrict office is open from 7:00 A.M. to 5:30 P.M. Monday through Thursday.

DISTRICT PERMITS:

Florida law requires all culverts and drainage systems that are connected to the drainage of any water control district to comply with the District's overall drainage plan.

Permits must be obtained for all culvert installations whether privately installed or installed by the District. To ensure conformity with grade requirements and culvert specifications all installations must be inspected by the District upon completion. Questions regarding the proper method of installations should be directed to Mike Paesch, Foreman of Flagler Estates Road and Water Control District.

ALL LANDOWNERS AND RESIDENTS OF FLAGLER ESTATES SHOULD BE AWARE:

Culvert permits are required and all landowner connections to the District drainage system must be authorized by the District. Culvert permits are to be obtained from the District office during the normal business hours.

The flow of water must not be obstructed. No shrubs or trees shall be planted the the swales and no vehicles shall be parked in the swale area. Landowners are responsible for maintaining the swale area in front of their homes and grass should not be allowed to grow up and fill in the swale area.

Landowners are responsible for maintaining their driveways so that water may flow through the culvert under the driveway. This requires cleaning out the ends of the culverts and keeping them free of debris, high grass, and sand a lot of the times.

Dumping on the land of others without their consent is forbidden by FLorida Statute. Do NOT dump grass clippings, yard waste, or any other refuse materials in the roadways, or into andy roadside swale, ditch, canal, or pond with the District !

Garbage collections and recycling is performed by Advanced Disposal. To dispose of appliances, residents must all Advanced Disposal at 904-827-1005.

UNDER NO CIRCUMSTANCES ARE THESE ITEMS TO� BE DISPOSED OF ON DISTRICT PROPERTY, WHICH INCLUDES ROADSIDE SWALES, DITCHES, CANALS, OR PONDS.

St. Johns county offers a recycling program for such things - Contact the county about this issue at: 904-824-9720 for proper disposal of these and other related refuse if you are in doubt.

HUNTING AND OTHER PROHIBITED ACTIVITIES:

Hunting On District property and the property of any landowner who does NOT provide specific consent.

Driving off-road onto the property of others without their permission, or onto lands of the District including any canals, secondary canals, or easements s prohibited and may violate Florida Statutes.

ATV's are NOT permitted on District roads, canals, secondary canals, or easements.

Timber clearing on property within flagler estates is regulated by county ordinances and state law. Please check with the County before contracting for timber clearing to prevent violations of law and potential damage to District works.
